Plaintiffs Brandy Wicks and Tony Ray Herbert (“Plaintiffs”) filed a civil lawsuit in the Circuit Court of St. Louis County, Missouri against Title Loan Company d/b/a The Loan Machine (“the lawsuit”). Plaintiffs filed the lawsuit on behalf of themselves and as a class action on behalf of the group or “class” of persons who: (1) were sued by collection lawsuits by The Loan Machine; (2) were delivered lawsuit papers by a person not appointed to serve papers; and, (3) had a default judgment entered against them. Plaintiffs allege that these judgments are void because the special process server who served the papers was not appointed to serve process.
The Loan Machine denies the allegations. The Loan Machine added The Barton Law Group, LLC, and Dennis J. Barton, III to the lawsuit alleging they were responsible for any damages caused by the entry of the default judgments. The Barton Law Group, LLC and Dennis J. Barton, III deny these allegations.
